Welcome to Mintshot. These Terms and Conditions ("Terms") govern your access to and use of the website at mintshot.ai and related services (collectively, the "Service") provided by Lowside Labs, Inc. ("Mintshot," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
1. Description of Service
Mintshot is an AI-powered platform that generates professional headshots from photos you upload. Our Service uses artificial intelligence to create high-quality, professional images for personal and commercial use.
2. Account Registration
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
You must be at least 18 years of age to use this Service. By creating an account, you represent and warrant that you are at least 18 years old.
3. Purchases and Credits
Purchasing
Mintshot operates on a credit-based system. When you purchase a photoshoot, you receive credits that can be used to generate AI headshots. All purchases are processed through Stripe, our third-party payment processor.
Credit Validity
Credits never expire. Once purchased, your credits remain valid indefinitely and can be used at any time.
Pricing
All prices are displayed in USD unless otherwise indicated. We reserve the right to modify pricing at any time. Price changes will not affect credits already purchased.
4. Our Satisfaction Guarantee
We want you to love your AI headshots. If you're not satisfied with your results, we offer a free reshoot or your money back. We're committed to making it right.
5. Refund Policy
Eligibility
Refund or reshoot requests must be submitted within 7 days of your purchase. You may request either:
- A free reshoot: We'll generate a new set of headshots at no additional cost.
- A full refund: We'll return your payment to the original payment method.
Non-Refundable Situations
Refunds are not available in the following circumstances:
- Downloaded photos: Downloading your generated headshots is considered using the product. Once you download your photos, refunds are no longer available.
- Failure to follow upload guidelines: If your results are unsatisfactory because you did not follow our photo upload guidelines (e.g., poor lighting, low resolution, obstructed faces), refunds may not be granted. We encourage you to review our guidelines carefully before uploading.
- Abuse of refund policy: To ensure fair use for all customers, we reserve the right to decline refund requests from accounts that demonstrate a pattern of repeated refund requests or abuse of our satisfaction guarantee.
How to Request a Refund
To request a refund or reshoot, contact us at support@support.mintshot.ai with your account email and order details. We will review your request and respond within 1-3 business days. If approved, refunds will be processed to your original payment method within 5-10 business days.
6. Ownership and License
Your Photos
You retain all ownership rights to the photos you upload to our Service. By uploading photos, you grant us a limited license to process them for the purpose of generating your headshots.
Generated Headshots
You own the headshots we generate for you. Once generated, you have full ownership and can use your AI headshots for any purpose, including commercial use, without restriction. We do not retain any rights to your generated images.
7. Acceptable Use
You agree not to use the Service to:
- Generate content depicting anyone other than yourself without their explicit consent
- Create deepfakes or misleading content intended to deceive others about someone's identity
- Impersonate others or create fraudulent representations of identity
- Generate explicit, adult, or NSFW content of any kind
- Harass, defame, or harm any individual
- Engage in any illegal activity or use generated images for unlawful purposes
- Circumvent or manipulate our systems, security measures, or policies
- Resell, redistribute, or commercialize the Service itself without our written permission
We reserve the right to suspend or terminate accounts that violate these acceptable use policies without notice or refund.
8. Account Termination
Termination by You
You may close your account at any time by contacting us at support@support.mintshot.ai.
Termination by Us
We may suspend or terminate your account at our discretion if you violate these Terms or engage in behavior that harms our Service or other users.
Effect of Termination
Upon termination, your access to the Service will cease. Unused credits are handled on a case-by-case basis. If you believe you have remaining credits and wish to discuss options, please contact our support team before or promptly after termination.
9. Intellectual Property
The Service, including its design, features, and content (excluding user-uploaded photos and generated headshots), is owned by Lowside Labs, Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without our written permission.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- AI-generated results will be satisfactory, accurate, or suitable for any particular purpose
- Any defects in the Service will be corrected
AI technology produces variable results. While we strive for high-quality outputs, we cannot guarantee that every generated headshot will meet your expectations. This is why we offer our satisfaction guarantee with free reshoots.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOWSIDE LABS, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
In no event shall our total liability to you for all claims arising from or relating to the Service exceed the amount you paid to us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Lowside Labs, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.
13. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lowside Labs, Inc. regarding the Service and supersede all prior agreements and understandings.
